By accessing and using games-miniatures.com (the “Site”), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or purchase our products.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified terms.

As a user of our Site, you agree to:

Gamegenic Store specializes in premium tabletop gaming products, including:

• Game sets and expansions (Against the Giants, Baldur’s Gate, Axis and Allies, etc.)

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your device’s display will accurately reflect the colors, textures, or details of our products.

All products are subject to availability. We reserve the right to limit quantities and discontinue products without notice. If a product is unavailable after you place an order, we will notify you and refund any payment for that product.

Restrictions on Use:

Placing Orders:

Order confirmation (via email) does not constitute acceptance of your order. We reserve the right to cancel any order before shipment.

Pricing:

All prices are in US Dollars (USD). We reserve the right to change prices at any time without notice. Despite our best efforts, occasional pricing errors may occur. If we discover an error in the price of a product you have ordered, we will notify you and give you the option to reconfirm your order at the correct price or cancel it.

Payment Methods:

We accept the following payment methods:

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

Sales Tax:

We collect applicable sales tax for orders shipped to locations where we have nexus. The amount of tax will be calculated and displayed during checkout.

Processing Time:

Orders are processed within 1-2 business days after placement. Processing time may be longer during peak seasons or promotional periods.

Shipping Methods:

We offer two shipping options:

• Standard Courier (DHL/FedEx): $12.95, delivery within 10-15 business days after shipment
• Free Shipping (EMS): Available for orders over $50, delivery within 15-25 business days after shipment

Delivery times are estimates and not guaranteed. Various factors including customs processing, weather conditions, and carrier delays may impact delivery times.

Shipping Limitations:

We ship to most regions globally but cannot deliver to some remote areas in Asia and other locations. If we are unable to ship to your location, we will notify you and cancel your order.

Order Tracking:

Once your order ships, we will provide you with tracking information via email. You are responsible for monitoring your shipment and providing appropriate delivery instructions.

Risk of Loss:

All products purchased from our Site are delivered to you by a third-party carrier. The risk of loss and title for such products pass to you upon our delivery to the carrier.

Return Policy:

We want you to be completely satisfied with your purchase. If you are not satisfied, you may initiate a return or exchange within 15 days of receiving your order.

Return Process:

To initiate a return:

1. Contact our support team at [email protected] within 15 days of receipt, providing your order number, items for return, reason for return, and preference for refund or exchange
2. Once approved, pack the item securely in its original packaging with all parts and accessories
3. Include a copy of your order confirmation or packing slip
4. Mail your return to: Gamegenic Store Returns, 12 Netherclift Way, Savannah, US 31411

We recommend using a trackable shipping method. You are responsible for the package until it reaches our facility. For international returns, mark the package as “Returned Goods” to avoid customs fees. You are responsible for return shipping costs unless the return is due to our error.

Refunds:

Once we receive and inspect your return:

• Refunds are processed within 3-5 business days
• The refund will be issued to your original payment method
• Original shipping costs are non-refundable unless the return is due to our error
• Refunds may take 5-10 business days to appear on credit/debit cards or 3-5 business days for PayPal
• International refunds are issued in USD; the amount in your local currency may vary based on exchange rates

Exchanges:

To exchange an item, follow the standard return process and clearly indicate which item you wish to receive. We will ship the new item once we receive your return. If the new item costs more, we will invoice you for the difference. If it costs less, we will refund the difference.

Damaged or Defective Items:

If your items arrive damaged or defective, contact us immediately at [email protected] with photos of the issue. We will promptly send a replacement or issue a refund, often without requiring you to ship the item back.

All content on this Site, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Gamegenic Store or our content suppliers and is protected by international copyright laws.

The Gamegenic Store name and logo, and all related product and service names, are our trademarks and may not be used without our prior written permission.

You may not:

• Reproduce, duplicate, copy, sell, or otherwise exploit the Site or any content for commercial purposes
• Use any meta tags or other “hidden text” using our name or trademarks
• Use our products to create derivative works for commercial purposes without permission

To the fullest extent permitted by law, Gamegenic Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Any interruption or cessation of transmission to or from the Site
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Site

Our total liability to you for any claim arising out of or relating to these terms or our products, regardless of the form of action, is limited to the greater of $100 or the amount you paid us for the product(s) that gave rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

These Terms and Conditions are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.

Any dispute relating in any way to your use of the Site or purchase of products from us shall be submitted to confidential arbitration in Savannah, Georgia, except that to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in Georgia.

Arbitration under these Terms shall be conducted under the rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
